German Data Protection Authority Opens Public Consultation on AI Models

Germany’s Federal Commissioner for Data Protection and Freedom of Information (BfDI) has launched a public consultation focused on the privacy risks posed by artificial intelligence, particularly large language models (LLMs).

 

The initiative, announced in Press Release 10/2025, invites input from researchers, developers, and other stakeholders to help shape practical, legally sound approaches to safeguarding personal data in the age of AI. According to Federal Commissioner Prof. Dr. Louisa Specht-Riemenschneider, the widespread deployment of AI models like ChatGPT has raised urgent questions about transparency, security, and data protection.

 

“AI models are revolutionizing numerous industries and simultaneously present us with major challenges,” said Specht-Riemenschneider. “Insights from practice enable us to make better data protection recommendations.”

 

BfDI emphasized that LLMs can reproduce personal data found in their training sets, which may allow inferences about identifiable individuals. The authority seeks to avoid vague or impractical regulations and instead build policy grounded in real-world experience.

 

“I want to avoid unrealistic and unclear regulations – but for that, I rely on the support of providers and researchers,” Specht-Riemenschneider added.

 

The consultation aims to increase legal certainty by promoting transparency and dialogue. It’s part of the BfDI’s broader effort to keep data protection law aligned with rapidly advancing technologies.
