Governor Phil Murphy has signed bipartisan legislation that establishes civil and criminal penalties for the creation and spread of deceptive AI-generated media, also known as deepfakes. The law, A3540/S2544, aims to protect individuals from malicious uses of artificial intelligence, particularly those that manipulate a person’s image, voice, or likeness to deceive or cause harm.
At a signing ceremony, Governor Murphy emphasized the state’s commitment to protecting New Jerseyans from digital misinformation. “While artificial intelligence has proven to be a powerful tool, it must be used responsibly,” Murphy said. “We stand with the victims of deepfake imagery and will continue to prioritize the safety and well-being of all New Jerseyans.”
The law was inspired in part by Francesca Mani, a student at Westfield High School and a victim of AI-generated explicit images. Mani, now a TIME100 Most Influential Person in AI, joined the Governor at the ceremony. “This victory belongs to every woman and teenager told nothing could be done,” she said. “It’s proof that with the right support, we can create change together.”
The new legislation makes it a third-degree crime to knowingly produce or distribute deepfake media with the intent to commit or further a criminal act. Offenders may face up to five years in prison and a fine of up to $30,000.
State officials say the law is a critical step to stay ahead of evolving threats posed by AI. “AI can be used to damage lives and reputations,” said Attorney General Matt Platkin. “This law provides carefully tailored criminal and civil safeguards to protect the public.”
The measure was co-sponsored by legislators including Congressman Herb Conaway and Senate Majority Leader Lou Greenwald. Advocates like the New Jersey Coalition Against Sexual Assault and the AFT New Jersey hailed the law as an important step toward protecting digital privacy and combatting image-based sexual violence.
