New York State Unveils Comprehensive AI Guidelines

New York State has launched a significant AI initiative named the “Acceptable Use of Artificial Intelligence Technologies.” The New York State Information Technology Policy NYS-P24-001 establishes comprehensive guidelines governing the acceptable use of AI technologies by New York State entities (SEs). Applicable to systems utilizing machine learning, natural language processing, computer vision, and other AI technologies with a potential impact on the public, the policy empowers SEs to leverage AI to advance their mission and fulfill business needs, subject to agency leadership approval. Crucially, the policy prohibits automated decision systems lacking human oversight and mandates that AI systems be explainable, transparent, fair, equitable, and devoid of harmful bias. SEs are required to conduct risk assessments in adherence to state standards.

 

The policy underscores the necessity for SEs to maintain human oversight of AI-aided decisions affecting the public. Comprehensive documentation of outcomes and methodologies, coupled with periodic validation of reliability, safety, and fairness, is mandated. Transparency in AI use is emphasized, requiring disclosure where the public interacts with SE systems. Privacy protection is paramount when processing personal, confidential, or sensitive information using AI, and adherence to state security policies and standards is mandatory. SEs must ensure the currency of AI systems and employ open standards where feasible, taking into consideration intellectual property implications through thorough review.

 

The policy establishes an inventory of in-scope AI systems, with new systems requiring reporting within 180 days of ITS guidance. Effective upon its January 2024 publication, the policy aims to foster responsible AI adoption among New York State entities. By upholding principles of accountability, transparency, fairness, and human oversight, NYS-P24-001 seeks to promote innovation and efficiency while safeguarding the public interest. SEs are obligated to request exceptions for non-compliance with the outlined guidelines.
