Rhode Island joins a growing list of states concerned about AI’s impact on elections. The Rhode Island House of Representatives unanimously voted on May 2 to approve H 7387, related to deceptive and fraudulent synthetic media in election communications. The bill would amend Title 17 of General Laws to address deceptive and fraudulent synthetic media in election communications.

 

The main crux of the legislation is that it prohibits distribution of deceptive synthetic media within 90 days of an election. It also allows candidates to seek relief and damages for violations. Candidates can seek injunctive relief against creators of deceptive synthetic media. Candidates may also pursue damages and recover attorneys’ fees and costs in legal actions against creators. The burden of proof in civil actions lies with the plaintiff, requiring clear and convincing evidence.

 

Under the bill, synthetic media includes manipulated images, audio recordings, or video recordings created using digital technology. However, the bill does not apply to specific broadcasting stations, satire/parody content, and certain media outlets. Radio and television broadcasting stations are exempt if they acknowledge the questionable authenticity of synthetic media.The act shall take effect upon passage.

 

The bill now heads to the Rhode Island Senate, where a companion piece of legislation is being considered. H 7387 has a decent chance of passing since it has support from Rhode Island Secretary of State Gregg Amore, who submitted written testimony on the bill back on March 26.
