Virginia Lawmakers Delay Decision on Deepfake Bill

It could be a while before one state government in the United States handles a bill relating to deepfakes and synthetic media created by AI. Virginia House Bill 697 (HB697) would have amended existing code sections on defamation and libel to expand the definition of “words” to include synthetic media. It also adds a new code section creating penalties for using synthetic media to commit fraud. However, lawmakers agreed to look at the bills next year in the Senate Courts of Justice Committee.

 

The bill would have defined synthetic media as any fabricated image, audio, or video created with AI to falsely depict a person. It would have amended the code section on defamation to state that the definition of “words” includes synthetic media. This means synthetic media portraying a person falsely could be considered defamatory. HB697 would have amended the code on libel and slander similarly, stating that the definition of “words” includes synthetic media. This means using synthetic media to insult or discredit someone could be prosecuted as libel or slander.

 

The bill would have added a new code section making it a Class 1 misdemeanor to use synthetic media to commit fraud. Violators can also be sued civilly for damages. This does not limit protections for online platforms under federal law. Finally, the bill would have required the Attorney General to convene a workgroup to study enforcement of laws on synthetic media use in fraud. The workgroup must report findings and recommendations to legislative committees by November 2024.
