The Argentine Agency for Access to Public Information (AAIP) has published a guide aimed at both public and private entities, focusing on transparency and the protection of personal data in the context of artificial intelligence (AI). The guide, titled “Guide for Public and Private Entities on Transparency and Protection of Personal Data for Responsible Artificial Intelligence,” seeks to address the growing integration of AI in decision-making processes, personalized user experiences, and process automation.

 

The Argentine AAIP’s guide serves as a comprehensive tool designed to accompany AI systems throughout their entire life cycle—spanning design, implementation, and maintenance—while placing particular emphasis on two key areas: algorithmic transparency and the protection of personal data. These focal points aim to ensure that AI systems are developed and used responsibly, safeguarding individual rights and promoting public trust.

 

The Argentine AAIP guide outlines several critical recommendations for organizations developing or implementing AI systems. These include:

 

  1. Conducting Impact Assessments: Before AI systems are put into operation, organizations are encouraged to conduct thorough assessments to identify and mitigate potential risks to data protection. This step helps ensure that personal data is handled responsibly and securely.

 

  1. Forming Multidisciplinary Teams: AI systems present both technical and ethical challenges, which are best addressed through diverse teams composed of professionals from various sectors. This approach fosters a comprehensive understanding of the potential risks and ethical implications of AI.

 

  1. Ensuring Explainability: The guide emphasizes the importance of transparency in AI systems. While explainability can present technical difficulties, particularly in complex systems, it is crucial that AI algorithms and their decision-making processes be understandable and accessible to those affected by their outcomes.

 

  1. Protecting Personal Data: At the heart of responsible AI development is the protection of personal data. The guide advocates for building AI systems with robust security measures that ensure proper data handling and respect the rights of data subjects.

 

  1. Addressing the Entire AI Lifecycle: The guide stresses the need to consider each stage of an AI system’s lifecycle, from design through to operation and eventual decommissioning. Each phase presents unique challenges that require specific recommendations to ensure ethical and responsible AI use.

 

The Argentine AAIP guide is part of a broader national initiative aimed at fostering transparency and protecting personal data in the context of AI. Known as the National Program for Transparency and Protection of Personal Data in the Use of Artificial Intelligence,” the program was established under Resolution 161/2023. The program promotes the development of regulations, capacity-building processes, and analysis frameworks to support the responsible use of AI in both the public and private sectors.

 

The guide is open for public consultation, with the Argentine AAIP encouraging feedback and recommendations from a wide range of stakeholders until October 30, 2024. Interested parties can submit their comments via email to [email protected].
