UPDATE — SEPTEMBER 2025: Since Argentina’s Agency for Access to Public Information (AAIP) released its 2024 “Guide for Public and Private Entities on Transparency and Protection of Personal Data for Responsible AI” under Resolution 161/2023, the initiative has moved from consultation to implementation. The public feedback phase closed in October 2024, drawing input from universities, tech companies, and international organizations. In early 2025, the AAIP began testing the guide through pilot projects in government agencies, particularly in digital services and healthcare, and expanded it with practical compliance tools such as model impact assessment templates and transparency checklists.

These efforts are now being integrated into Argentina’s upcoming “AI National Strategy 2025–2030,” which positions the guide as a baseline standard aligned with OECD principles, UNESCO’s AI ethics framework, and the EU AI Act. Internationally, Argentina has signed a memorandum of understanding with Brazil’s data protection authority (ANPD) and is sharing its work through the Ibero-American Data Protection Network (RIPD), strengthening regional collaboration on responsible AI governance.

Looking ahead, the AAIP is expected to publish a revised version of the guide by late 2025. Regulators are actively discussing whether to shift from voluntary guidance toward binding rules for high-risk AI systems in finance, healthcare, and public-sector decision-making. In less than a year, Argentina’s framework has evolved from a consultative document into a cornerstone of both national AI strategy and regional cooperation, setting the stage for stronger regulatory enforcement in 2026.

The Argentine Agency for Access to Public Information (AAIP) has published a guide aimed at both public and private entities, focusing on transparency and the protection of personal data in the context of artificial intelligence (AI). The guide, titled “Guide for Public and Private Entities on Transparency and Protection of Personal Data for Responsible Artificial Intelligence,” seeks to address the growing integration of AI in decision-making processes, personalized user experiences, and process automation.

 

Strengthening Transparency and Trust in AI

 

The guide serves as a roadmap for organizations developing or deploying AI systems. It covers every stage of the AI lifecycle—from design and implementation to maintenance—and highlights two priorities: transparency and privacy protection. By emphasizing these principles, the AAIP aims to ensure AI systems operate responsibly and uphold public trust. The agency urges organizations to conduct impact assessments before deploying AI systems. These assessments help identify and reduce risks related to personal data and algorithmic bias. The guide also recommends forming multidisciplinary teams, combining expertise from ethics, law, data science, and policy to handle AI’s technical and social implications effectively.

A central theme of the guide is explainability. The AAIP stresses that AI systems must be understandable, even when they rely on complex models. The new guide is part of Argentina’s National Program for Transparency and Protection of Personal Data in the Use of Artificial Intelligence, created under Resolution 161/2023. The program aims to support regulatory development, capacity-building, and risk analysis for responsible AI across both public and private sectors. As part of the rollout, the AAIP opened a public consultation period, inviting comments from universities, companies, and civil-society organizations until October 30, 2024.
