The U.S. Government Accountability Office (GAO) has issued a pressing update to the Office of Science and Technology Policy (OSTP), highlighting critical recommendations for the regulation and oversight of artificial intelligence (AI) within federal agencies. In a letter dated August 15, 2024, Comptroller General Gene L. Dodaro addressed OSTP Director Arati Prabhakar, emphasizing the urgent need for the OSTP to implement key recommendations that will significantly impact the government’s approach to AI regulation and broader technological governance.

 

Central to the GAO’s recommendations is the need for OSTP to take decisive action in regulating AI. The GAO has urged OSTP to enhance its oversight by clearly communicating with federal agencies about their responsibilities under existing AI regulatory frameworks. Specifically, the GAO has recommended that OSTP inform agencies of their roles as implementing bodies under the Regulation of AI Applications memorandum (M-21-06), which was established to guide the ethical and responsible use of AI across the federal government.

 

The GAO’s concern stems from the fact that some agencies are reportedly unaware of their designation as implementing agencies under the memorandum, which could lead to inconsistencies in how AI is managed across the federal landscape. Without clear guidance and communication from OSTP, these agencies may not fully understand or comply with the regulatory requirements, potentially undermining the government’s ability to manage the complexities and risks associated with AI. The GAO has made it clear that full implementation of this recommendation is critical to ensuring that AI technologies are used safely, ethically, and effectively within federal operations.

 

While AI regulation is at the forefront of the GAO’s recommendations, the letter also touches on other important areas where OSTP’s action is needed, including managing climate change risks and advancing national goals through strategic planning. In addition to AI, the GAO highlights the importance of addressing research security risks, particularly in relation to foreign ownership and control. The GAO recommends that OSTP facilitate better information sharing among federal agencies to safeguard research activities from foreign threats. This recommendation, while crucial, is framed within the broader context of ensuring that AI technologies, which often intersect with sensitive research areas, are not compromised.

 

The GAO’s letter also points out that the OSTP has made some progress in other areas, such as enhancing collaboration on public access to research results and issuing reports on high-performance computing. However, the GAO stresses that these achievements should not detract from the pressing need to address AI regulation comprehensively. The letter encourages OSTP to prioritize the establishment of performance measures, detailed implementation plans, and clear communication strategies that will support federal agencies in managing AI effectively.

 

The GAO’s update serves as a call to action for OSTP to take the lead in shaping the federal government’s approach to AI regulation. By implementing the recommended measures, OSTP can help ensure that AI is integrated into federal operations in a way that is transparent, accountable, and aligned with national interests.
